Mixpanel Transparency Report

Reporting Period: July 1, 2022 to December 31, 2022

Mixpanel is committed to respecting the privacy rights of individuals in every country around the world. Transparency is a cornerstone of any privacy program and we go to great lengths to ensure that we provide as much insight as possible into how your data is used and disclosed. Like many companies, Mixpanel may receive requests to produce information from law enforcement agencies. These requests can come in the form of search warrants, subpoenas, court orders, preservation requests and National Security Process letters.

While Mixpanel must comply with lawful requests from law enforcement authorities, we are also committed to reviewing requests to ensure they are legally binding, questioning law enforcement, as permitted by law, on the scope of the requests to the extent we deem them to be overly broad, and publishing the results of this process to the extent that we are permitted to under applicable law.

This Transparency Report covers all requests received by Mixpanel between July 1, 2022 and December 31, 2022. We publish these reports every six months, delayed by 180 days.

United States of America: National Security Process Letters

While we want to be as transparent as possible, Mixpanel is prohibited from providing certain details regarding requests issued under FISA or 18 U.S.C. § 2709 (National Security Letters or NSLs). Mixpanel reports aggregated numbers on NSLs received within specified bands of 250. These reports are delayed by a 6 month period, as required by applicable law.

Definitions

“Content” & “Non-Content” data, as defined in the Stored Communications Act (18 U.S.C. §§ 2701-12) mean the following:
- “Content Data” means information contained in a customer database, which the customer has collected through their use of Mixpanel's products and services. Content based information may include analytics data, communications with Mixpanel, or other non-content based information.
- “Non-Content Data” means basic account information about our customer that may include their name, address, email address, billing information, and date of account creation. It may also include basic information about the services purchased. Non-Content Data responses may include this information or no information at all.
“National Security Letter” or “NSL” means letters or demands for information, similar to a subpoena, typically issued by US national law enforcement agencies, as described in Electronic Communications Privacy Act (18 U.S.C. § 2709); the National Security Act (50 U.S.C. § 3162), the Right to Financial Privacy Act (12 U.S.C. § 3414), and the Fair Credit Reporting Act (15 U.S.C. §§ 1681u, v.), USA PATRIOT Act (Section 505, P.L. 107-56, 115 Stat. 365-66 (2001)) , and the USA Patriot Act Reauthorization of 2006 (P.L. 109-178, 120 Stat. 278 (2006))
“FISA” means the The Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. §§ 1801 et. sec.)
‘“Subpoena” means a legal demand for the compulsory production of documents in a civil or criminal case.
“Court Order” means an order issued by a court that requires a party to do or abstain from doing a specific act.
“Search Warrant” means an order issued by a court at the request of law enforcement, issuing a finding of probable cause. Search Warrants are required for law enforcement to obtain Content Data from Mixpanel.
“Emergency Request” means an event that involves the imminent danger of death or serious physical injury to a person.
“Preservation Request”. Compulsory requests from law enforcement agencies that require Mixpanel to preserve or not delete information about our customers or employees.
